1. Acceptance of Terms
By accessing or using the AnyTrip website (anytrip.com.au), iOS application, or Android application (collectively, the “Service”), you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Service.
These Terms form a legally binding agreement between you and JXEENO PTY LTD (“AnyTrip”, “we”, “us”, or “our”), the operator of the Service.
2. About AnyTrip
AnyTrip is a public transport information service that provides real-time and scheduled transit data, trip planning, and related tools across Australia. The Service is available via our website and mobile applications for iOS and Android.
AnyTrip is an information service only. We do not operate any public transport services and are not a transport provider, ticketing agent, or booking platform.
3. Eligibility
You may use the Service if you are at least 13 years of age. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service.
4. Accounts and Registration
Some features of the Service may require you to create an account. When you do so, you agree to:
- Provide accurate and complete information during registration.
- Keep your login credentials secure and confidential.
- Notify us promptly of any unauthorised use of your account.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
5. Permitted Use
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes, unless you have entered into a separate Enterprise licence agreement with us.
5.1. Personal and Non-Commercial Use
The Free and Plus tiers of the Service are for personal, non-commercial use only. Account sharing is not permitted. Each account is for use by a single individual.
5.2. Commercial Use
Commercial use of the Service requires an Enterprise licence. Commercial use includes, but is not limited to:
- Use in transport operations rooms or control centres.
- Display on public-facing screens or digital signage.
- Integration into commercial products or services.
- Any use in the course of business operations where the Service provides a commercial benefit.
If you are unsure whether your intended use requires an Enterprise licence, please contact us.
5.3. Prohibited Conduct
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the Service.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Use automated systems (including bots, scrapers, or crawlers) to access the Service without our prior written consent.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service for any unlawful purpose or in violation of any applicable Australian law.
- Misrepresent your identity or affiliation with any person or entity.
6. Data and Transit Information
AnyTrip aggregates public transport data from various government and third-party sources, including GTFS feeds provided by Australian state and territory transport authorities.
Data sourced from government open data portals is used in accordance with the applicable Creative Commons or open data licences. Attribution to original data providers is available within the Service where required.
7. Intellectual Property
All content, design, graphics, software, code, and other materials made available through the Service (excluding third-party transit data provided under open licences) are the property of AnyTrip or its licensors and are protected by Australian and international intellectual property laws.
The AnyTrip name, logo, and branding are trade marks of JXEENO PTY LTD. You may not use our trade marks without our prior written consent.
8. Third-Party Services and Links
The Service may contain links to third-party websites or services not owned or controlled by AnyTrip. We are not responsible for the content, privacy practices, or availability of any third-party services. Your use of third-party services is at your own risk and subject to their terms and conditions.
Our integration with mapping providers (such as Google Maps or Apple Maps) is subject to those providers' respective terms of service.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect your personal information.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
AnyTrip does not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free.
- Transit information or trip planning results will be accurate or reliable.
- Any defects in the Service will be corrected.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified by agreement.
11. Limitation of Liability
To the maximum extent permitted by Australian law, AnyTrip and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including:
- Missed connections, delays, or any loss arising from reliance on transit information provided through the Service.
- Loss of data, profits, or business opportunity.
- Any unauthorised access to or alteration of your data.
Where our liability cannot be excluded under the Australian Consumer Law, our total liability is limited to re-supplying the relevant service or paying the cost of having the service re-supplied.
12. Indemnification
You agree to indemnify, defend, and hold harmless AnyTrip and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. If you have an account, you may request its deletion by contacting us.
Sections of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, limitations of liability, and indemnification.
14. Changes to These Terms
We may modify these Terms at any time. If we make material changes, we will update the "Last Updated" date at the top of this page and, where practicable, provide notice through the Service.
Your continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales and any courts of appeal therefrom.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
